Terms and conditions

Conditions applicable to any rental order placed with LE BAR MOBILE.

These general terms and conditions of sale (hereinafter the “Terms”) govern any rental service offered by LE BAR MOBILE, a brand operated by JOUR & NUIT (hereinafter “LE BAR MOBILE”).

Any order implies the Customer’s unreserved acceptance of these Terms. The Customer waives any right to invoke their own purchasing terms. Each Customer declares having read, understood and accepted the Terms without reservation. LE BAR MOBILE reserves the right to modify these Terms at any time; the applicable Terms are those in force on the date of the order.

Any failure by LE BAR MOBILE to enforce any provision of these Terms at any given time shall not be construed as a waiver of the right to enforce such provision later.

Article 1 · Order

Any order must be placed in writing (signed quote, email confirmation or purchase order) and must be accompanied by the down payment provided in Article 11. The order is considered firm and definitive once LE BAR MOBILE receives the down payment and the Customer’s written confirmation.

Material availability is guaranteed subject to stock at the time the order is confirmed. LE BAR MOBILE reserves the right to refuse any order from a Customer with whom there is a commercial dispute, regardless of cause.

The benefit of the order is strictly personal to the ordering Customer. It cannot be assigned without the prior written consent of LE BAR MOBILE.

Article 2 · Pricing

Our prices are stated in euros, excluding tax (excl. VAT). Applicable VAT (20%) is added to the net amount to obtain the total amount including tax.

Unless expressly stated otherwise in the quote, rental prices are exclusive of transport, handling, installation, dismantling, set-up and any related services. These ancillary services are billed in addition at the rate in force or by quote.

Prices apply for the rental duration set out in the quote. Any use beyond this duration will be subject to express agreement and additional billing. Any delay in returning the equipment will be billed at the rate in force.

For customisation services (custom PVC printing, ice cube engraving with customer logo, ice stamp, heat stamp, stencil, vinyl logo application on stainless steel bar), a minimum production lead time of 10 working days before the event is required.

Article 3 · Security deposit

For any order, unless otherwise agreed, a security deposit of €5,000 (five thousand euros) is required from the Customer.

This deposit may be provided as:

  • a credit card pre-authorisation via a secure link provided by LE BAR MOBILE,
  • or a banker’s cheque payable to JOUR & NUIT, the holder of which must be the ordering Customer.

The deposit will be returned (or the pre-authorisation released) after a contradictory inventory of returned equipment and after full payment of all sums due. No equipment will be made available to the Customer without prior provision of the requested deposit.

In the event of missing, damaged or unreturned equipment, the deposit may be cashed by LE BAR MOBILE up to the amount of the loss observed, without notice and without prejudice to any other recovery action.

Article 4 · Cancellation

Any cancellation, total or partial, for any reason, must be notified in writing (email or letter) to LE BAR MOBILE. The financial consequences are as follows:

  • Cancellation more than 30 days before the date of the service: 50% of the net amount (excl. VAT) is retained (corresponding to the down payment). The remaining 50% will be credited as a voucher, valid for 12 months from the date of cancellation, usable on any LE BAR MOBILE service.
  • Cancellation between 30 days and 14 days before the date of the service: 75% of the net amount (excl. VAT) is retained.
  • Cancellation less than 14 days before the date of the service: 100% of the net amount (excl. VAT) is invoiced (the balance being due 14 days before the event).

No cancellation, total or partial, may give rise to a cash refund. Equipment not used or returned before the agreed return date may not be refunded or deducted from the invoice in any way.

LE BAR MOBILE reserves the right to cancel a service if the Customer fails to comply with any clause of the contract. Down payments will then be definitively retained by LE BAR MOBILE as compensation.

If LE BAR MOBILE is unable, for reasons not attributable to it (notably force majeure), to provide all or part of the ordered services, it shall refund the sums paid, less any costs already incurred for preparing the event.

Article 5 · Transport and provision

Delivery of the equipment is optional. The Customer may choose between the following two options:

  1. Delivery by LE BAR MOBILE: Paris intra-muros (€250 excl. VAT), Île-de-France (€350 excl. VAT), rest of France (by quote). Delivery includes transport, on-site set-up and equipment retrieval after the event.
  2. Customer pickup at the LE BAR MOBILE warehouse, with no transport fees. The Customer is responsible for ensuring their vehicle is suitable for transporting the rented equipment (volume, dimensions, securing straps). The Customer is solely responsible for transport, loading, unloading and return. LE BAR MOBILE staff are not authorised to load or unload equipment into a vehicle owned by the Customer.

For any delivery, the Customer must communicate in writing to LE BAR MOBILE the exact address, access constraints (floor, lift, code, parking, restricted roads) and times of provision. In case of error or omission in the information provided, absence of a person authorised to receive the equipment, or impossibility of access to the location, LE BAR MOBILE shall not be held liable for the impossibility of delivery or retrieval. Any additional service (waiting time, additional handling, return without delivery, additional travel) will be billed at the rate in force.

LE BAR MOBILE reserves the right to deliver the day before and to retrieve the rented equipment within 72 hours of the end of the event, unless otherwise agreed.

Additional handling of €120 excl. VAT (€240 excl. VAT for the 4-metre round bar) is invoiced for configurations including two or more bars, or finishes other than PVC.

Article 6 · Provision and return of equipment

Upon provision, the Customer acknowledges receiving the equipment in good condition, fit for purpose, compliant with applicable hygiene and safety standards, and complete. A contradictory inventory is carried out at the time of provision. In the absence of a signature or a Customer representative, only the LE BAR MOBILE inventory shall prevail.

The Customer agrees to return the rented equipment in its original condition, clean, free of any residue (food, liquid, vinyl, waste), sorted and reconditioned in its original bins and trolleys, at the exact agreed location (pickup point or delivery address).

In case of equipment returned unsorted, unconditioned, dirty, returned to a location other than the one agreed, or any other reason preventing LE BAR MOBILE from carrying out the inventory on site, the contradictory inventory will be carried out at our warehouses. Penalties for sorting, cleaning or reconditioning may be applied at the rate in force.

In case of doubt about the operation or integrity of the returned equipment, LE BAR MOBILE reserves the time objectively necessary for full verification before returning the deposit.

Article 7 · Use of equipment

The Customer agrees to use the rented equipment in accordance with its usual purpose (serving beverages and bar preparations) and to do nothing or allow nothing to be done that could damage it. No modification, transformation or repair may be made to the equipment without the written consent of LE BAR MOBILE.

The Customer certifies being capable of using the rented equipment, or having authorised and qualified personnel. Throughout the rental period, the Customer is required to safeguard the equipment and protect it against any damage: vandalism, theft, weather, wind, rain, snow, frost, overload, etc.

The Customer is not entitled to any compensation in the event of equipment failure. Any missing, damaged or unreturned equipment will be invoiced to the Customer at its replacement value, plus compensation intended to cover the duration of equipment unavailability for LE BAR MOBILE.

Article 8 · Custom personalisation

Any customisation service undertaken for the Customer (custom PVC printing, ice cube engraving with logo, ice stamp, heat stamp, stencil, vinyl logo application on stainless steel bar) is non-refundable. As production of these custom elements is launched upon receipt of the down payment, no cancellation, total or partial, may give rise to a refund of these services, regardless of the cancellation date.

The Customer warrants to LE BAR MOBILE that they hold the rights to use the logos, trademarks, visuals or content provided for customisation. The Customer indemnifies LE BAR MOBILE against any third-party claim based on infringement of intellectual property rights, image rights or any other applicable right.

Article 9 · Water, electricity and on-site set-up

LE BAR MOBILE bar stations are equipped with a self-contained sink supplied by 20-litre canisters (autonomy of approximately 200 cocktails per canister). The Customer may, on request, arrange a connection to the venue’s water supply or request additional canisters (by quote).

The Customer agrees to provide a compliant electrical supply (standard 220V outlet) when using equipment requiring connection (Hoshizaki ice machine, sound system, etc.).

The Customer agrees to provide a location suitable for setting up the equipment (stable and flat ground, clear access). Any installation must be arranged so as not to obstruct circulation in line with applicable safety standards (emergency exits, fire access roads, public-establishment standards).

Article 10 · Invoicing

The final invoice is issued and delivered to the Customer after the end of the service, including the return and inspection of the equipment. Invoicing is made in the name of the ordering Customer as identified in the quote and may not be modified without the prior written agreement of LE BAR MOBILE.

Article 11 · Payment

Unless otherwise agreed, the payment terms are as follows:

  • Down payment of 50% of the gross amount upon signing the quote, payable to JOUR & NUIT.
  • Balance (remaining 50%) payable no later than 14 days before the date of the service, by bank transfer or banker’s cheque.

Accepted payment methods: bank transfer, credit card (via secure link), banker’s cheque. Payment by ordinary cheque is only possible with the express written agreement of LE BAR MOBILE.

In case of non-payment by the due date, the Customer is liable, without notice:

  • for late-payment penalties equal to 10 times the legal interest rate in force, calculated on the total amount remaining due from the due date,
  • for a flat-rate recovery fee of €40 (Article L.441-10 of the French Commercial Code),
  • for a penalty clause equal to 15% of the sums due, as compensation,
  • for any litigation and judicial intervention costs incurred.

In case of non-payment of the invoice within 15 days of its issue date, LE BAR MOBILE reserves the right to cash the security deposit without notice and to suspend any ongoing service, without prejudice to any other action.

For any complaint relating to invoicing, the Customer has a maximum period of 10 days from the date of issue of the invoice.

Article 12 · Liability, retention of title and insurance

The rented equipment remains the entire property of LE BAR MOBILE / JOUR & NUIT. The Customer agrees not to allow it to be seized by their creditors and not to sublet or pledge it to third parties.

Liability, risks, material and legal custody of the rented equipment are transferred to the Customer upon provision (from delivery or pickup). The Customer assumes this custody under their sole responsibility until the equipment is effectively returned.

The Customer shall, at their own expense, take out a civil liability insurance contract to cover their liability during the rental. A certificate of insurance may be requested by LE BAR MOBILE.

The Customer agrees to indemnify LE BAR MOBILE against any claim of any nature whatsoever which may be brought by their staff, guests or any third party in connection with the service, in particular for any damage to property or persons attributable to the Customer or any person acting on their behalf.

No claim relating to the service shall be admissible beyond a period of 48 working hours after the end of the service. No compensation for loss of enjoyment or commercial loss, of any nature whatsoever, may be claimed from LE BAR MOBILE.

Article 13 · Force majeure

LE BAR MOBILE shall not be held responsible for delays, defaults or impossibilities of performance due to force majeure or any cause beyond its control, such as (without limitation): strike, exceptional weather, accident, fire, official prohibition, pandemic, lockdown measure, administrative closure, serious supplier failure.

Article 14 · No right of withdrawal

In compliance with Article L.221-28 10° of the French Consumer Code, mobile bar rental services for an event on a fixed date constitute “services of accommodation, other than residential accommodation, transport of goods, car rental, catering or leisure activities which must be provided on a specific date or for a specific period”. As such, the Customer, whether a consumer or a professional, does not have any right of withdrawal.

Article 15 · Consumer mediation

In compliance with Articles L.611-1 et seq. of the French Consumer Code, in case of a dispute between a consumer Customer and LE BAR MOBILE that could not be resolved amicably, the Customer may use the free service of the following consumer mediator:

Article 16 · Jurisdiction

Any dispute relating to the performance or interpretation of these Terms shall, failing amicable resolution, fall under the exclusive jurisdiction of the Paris Commercial Court.

These Terms are governed by French law. The contract represents the entire obligations between the parties relating to its subject matter. No prior document may give rise to any obligation under these Terms.

Article 17 · Communication and image rights

The Customer authorises LE BAR MOBILE to use photographs of the services performed (atmosphere shots, set-ups, equipment installed, without identifiable portraits of guests) for promotional purposes on its website, social networks and commercial materials, unless the Customer expressly requests otherwise in writing prior to the service.

Article 18 · Personal data protection (GDPR)

The Customer’s personal data is collected by JOUR & NUIT, data controller, for purposes of business management, invoicing, fraud prevention and commercial prospecting.

The data collected may include: name, first name, email, phone, postal address, business name, SIRET, K-bis, RIB, banking data (handled by our secure payment provider).

This data is never shared or sold to third parties. It may only be transmitted in the context of contract execution (payment, logistics subcontracting). It is kept for the legal duration, i.e. 10 years after the end of the contractual relationship, in compliance with accounting and tax obligations.

In compliance with the French Data Protection Act of January 6, 1978 as amended and the General Data Protection Regulation (GDPR), the Customer has the following rights: access, rectification, erasure, restriction of processing, objection, portability.

To exercise these rights or for any question relating to the processing of personal data, the Customer may write to: bonjour@lebarmobile.paris. The Customer also has the right to lodge a complaint with the French data protection authority (CNIL, www.cnil.fr).
